When most people purchase auto insurance, they focus on the monthly premium cost, not the fine print buried inside their policy. Unfortunately, that fine print can make the difference between being fully compensated after a serious accident and being left with tens of thousands of dollars in medical bills.
In Virginia, one of the most important — and most misunderstood — coverage choices surrounds Uninsured/Underinsured Motorist (UIM) coverage. Specifically, there needs to be clarity on the difference between Traditional UIM and Enhanced UIM.
I recently represented a client who learned this lesson the hard way.Let me explain:
What is UIM coverage?
Underinsured Motorist (UIM) coverage is part of your auto insurance policy. It protects you and your passengers when the at-fault driver does not have enough insurance to fully compensate you for your injuries, lost wages, and damages.
In Virginia, drivers now have two options: Traditional UIM coverage or Enhanced UIM coverage. This has been available for all Virginia policies since July 1, 2023.
The difference between the two can be substantial.
With traditional UIM coverage, your insurance company is allowed to reduce the at-fault driver’s liability coverage. This is referred to as an “offset” of the UIM coverage.
Here’s how that works in practice:
The at-fault driver has: $50,000 in liability coverage
You have: $100,000 in Traditional UIM coverage
Under Traditional UIM rules, your insurer subtracts the at-fault driver’s $50,000 from your $100,000 UIM policy, so you’re limited to $50,000 in UIM coverage.
Result:
Your maximum recovery is capped at $50,000 + $50,000 UIM for a total of $100,000 – not $150,000.
With Enhanced UIM coverage, there is no offset. Your coverage is stacked on top of the at-fault driver’s coverage, giving you greater protection.
Using the same example:
The at-fault driver pays: $50,000 [$50,000 + $100,000]
Your enhanced UIM pays: Up to $100,000 without an offset
Result:
Your total available recovery is $150,000.
This additional coverage can be life-changing for someone with serious injuries.
A real-world example: Losing $30,000 over an $11 decision
In my client’s case, they carried the Traditional UIM coverage instead of Enhanced UIM. Because of the offset rules under traditional UIM, they lost out on $30,000 in available compensation. The cost to add Enhanced UIM coverage to their policy would have been only $11.00 per policy period. That’s it, $11 over a 6-month policy period. For less than the cost of lunch, this client could have obtained an additional $30,000 for themselves and their family.
Medical bills, missed work, long-term treatment, and pain don’t disappear just because the at-fault driver was underinsured. When coverage falls short, the financial burden often lands squarely on the injured person. Enhanced UIM coverage is one of the most cost-effective protections available to Virginia drivers. Yet, many policyholders either:
- Don’t understand the difference
- Aren’t given enough information about UIM coverage to make a decision
- Assume all UIM coverage works the same way.
The takeaway for Virginia drivers
As a personal injury attorney, I feel it’s vital to share useful advice to ensure that Virginians can better understand the fine print. Here are some key takeaways:
- Traditional UIM coverage can significantly limit your recovery.
- Enhanced UIM coverage allows your insurance policy to fully protect you.
- The cost difference is often minimal — sometimes just a few dollars per policy period.
- The financial impact after a crash can be tens of thousands of dollars, making it even more compelling to acquire Enhanced UIM.
- The policy default is usually Enhanced UIM. If you have to agree to receive the lesser Traditional UIM, or if your insurance agent or company suggests it, we recommend you decline that option and pay the small additional fee to keep the Enhanced UIM.

If you’ve been injured in a car accident or want help understanding whether your policy includes Enhanced UIM coverage, it’s worth having your policy reviewed by an attorney who handles auto injury cases regularly. Insurance is supposed to protect you — not surprise you when you need it most.
